JSO, It's just that too often those who screw up aren't in a position to concern themselves with the penalties. Either they're acting out of panic, as in Bell's shooting, or they're psychpaths.

Gun ownership would be fine if it were restricted to guns comparable to those in existence when the Consitution was written. Our founding fathers couldn't anticipate that not only are today's weapons easy to be used, they're begging to be used. During the Revolutionary War, joining the Continental Army required having you're two front teeth. They were needed to rip open the small paper packet required to get off one shot.

In other words, shotguns are okay to keep at home. Hunting rifles must be kept in a state armory and checked out for use. Hands guns for private citizens, except those involved in security work, and assault weapons verboten.

I know that gun owners think those opposed are hopelessly naive. And to some extent they are. I admit to feeling defenseless without one.

Thanks for elucidating the Bell incident. I work in Manhattan and haven't followed it. The Amadou Diallo shooting in 1999 was just so tragic, I can't deal with cop shootings anymore.

Russ:

As I've said before, I believe gun ownership is fine, but it carries substantial responsibility and accountability. Screw up with deadly force, and one should have to pay dearly.

Accidental shootings, as well as school and workplace shootings, are the price we pay for keeping our guns. I guess it's worth it to America.

I didn't really know anything about this case, and find your speculation on the facts to be remarkably reasoned and plausible. You're right - no way the jury convicts.

I guess we can only hope that the NYPD and other police agencies around the country take a lesson from the case, huh?
